Selected Results*

Great Clips, Inc. v. Hair Cuttery of Greater Boston, L.L.C. and Great Cuts, Inc. (1st Cir. 2010):  In trademark infringement case, the U.S. Court of Appeals affirmed the previous ruling by the district court confirming client Great Clips' right to use its trademarked name throughout the United States, including the New England market.

Imation Corp. v. Koninklijke Philips Elec. N.V., et al., (Fed. Cir. 2009): Convinced the appellate court to reverse the entry of judgment on the pleadings dismissing two of Imation's key counts, and instead to order judgment for Imation on the question of whether certain entities formed or acquired later qualify as "subsidiaries" that could benefit from Imation's patent license with Philips.

Obtained summary judgment dismissing purported nationwide class action for false advertising in Cook County before class certification.  The Illinois Court of Appeals affirmed. 

Along with other firm lawyers, is defending national consumer class actions in multiple forums that involve allegations of false advertising.

Intergraph v. Dell, Hewlett Packard and Gateway: Represented Intergraph Corp. in patent litigation involving microprocessor system design in a case venued in East Texas. Recovered a total of $500 million in settlements as follows:

  • Hewlett Packard $141 million, with cross licenses;
  • Dell/Intel $225 million;
  • Gateway $12 million plus ongoing royalties;
  • AMD $20 million plus potential future royalty profits;
  • IBM $10 million plus a license to IBM's portfolio;
  • Fujitsu $9.75 million;
  • Toshiba and NEC, confidential settlements

    Lead Licensing campaign following litigation:
  • Sony $15 million;
  • Acer $7.5 million; and
  • Other confidential licenses
