Briefed a summary judgment motion that resolved all of the claims asserted against our client, an equipment manufacturer, in a suit against seventeen defendants involving an $80 million property damage claim. Our client was the lead defendant in this suit by the developer of a hotel, casino, resort and spa in New Jersey.

Obtained dismissal of our client, an equipment manufacturer, in a suit alleging negligence and gross negligence brought by an injured individual in Texas. The court dismissed the case with prejudice after granting our motion for summary judgment on the ground that our client owed the plaintiff no duty of care.

Successfully resolved a dispute between our client, a commercial property insurer, and a condominium association that was alleging breach of insurance contract. Ms. Davis briefed a summary judgment motion arguing that a code upgrade to undamaged property was not covered. During the pendency of that motion, the parties settled for a confidential amount.

Obtained dismissal of our client, a commercial general liability insurer, from a suit in Georgia against five defendants in which the plaintiff, a general contractor, alleged our client breached an insurance contract. Ms. Davis briefed a motion to dismiss on the ground that our client owed no duty to defend or indemnify the plaintiff.

Represented an excess commercial property insurer in an approximately $30 million suit alleging breach of insurance contract and bad faith claims brought by a performing arts center in Florida. The case ultimately settled at mediation for a confidential amount. As part of the trial team, Ms. Davis was responsible for many aspects of the litigation, including: managing the review of electronic discovery, which consisted of over 100,000 pages; deposing non-party records custodians and fact witnesses; drafting discovery and discovery responses; assisting with drafting expert disclosures; assisting with deposition preparation of experts and corporate representatives; defending expert depositions; drafting discovery, dispositive, and sanctions motions and motions in limine; and presenting arguments at a jury focus group.

**Past results are reported to provide the reader with an indication of the type of litigation in which we practice and does not and should not be construed to create an expectation of result in any other case as all cases are dependent upon their own unique fact situation and applicable law.
