Subrogation Not A Safe Bet Against Additional Insureds

Law360, New York (January 04, 2012, 1:45 PM ET) -- After a new addition to the Borgata Hotel, Casino and Spa in Atlantic City, N.J., caught fire during construction, the owner filed a lawsuit seeking to recover $80 million from a slew of defendants involved in the design and construction of the addition. The Superior Court of New Jersey, Atlantic County, Law Division recently granted partial summary judgment in the amount of $40 million to certain contractors and subcontractors involved in the design and construction of the addition to the Borgata, ruling that those entities are additional insureds under a policy of all-risk property insurance issued to the owner.[1]
