ND Landowners Sue Over Mineral Rights For State Oil Leases

Law360, New York (March 14, 2012, 3:23 PM ET) -- North Dakota violated landowners’ Fifth Amendment rights when it leased mineral rights from land near waterways to oil exploration companies, several landowners allege in a proposed class action filed Monday in state court.

The lawsuit alleges that when the state issued the leases it trampled on the rights of landowners and overlooked state and federal laws in order to profit from new oil exploration techniques such as hydraulic fracturing and horizontal drilling.
